Oftel Publishes Guidelines On Access Obligations To Communications Networks

New guidelines that set out how Oftel will implement access obligations imposed on a communications network operator with significant market power have been published today by Oftel.

The guidelines explain how Oftel will apply the provisions set out in the new EU Access and Interconnection Directive. In particular, the access guidelines:

  • say that SMP operators given an access obligation will need to meet all reasonable requests for access;
  • deal with the imposition of access to innovative products;
  • consider non-discrimination; and
  • require that all requests for access are handled equally

Any requirements that might be necessary under the new Directive will need to be in place by July 2003.

Welcoming the guidelines, David Edmonds Director General of Telecommunications said today:

"Competition is essential to create a dynamic and diverse communications sector.

"Publishing these guidelines will provide clarity about the types of access obligation that could be imposed on SMP operators.

"The guidelines describe the circumstances under which an access obligation may be imposed and the various complementary obligations that could be necessary to guarantee fair competition"

This is available from www.oftel.gov.uk/publications/eu_directives/2002/intg0902.htm It covers who will be entitled to interconnection under the new Directive and what is proposed to replace the Annex II list (the list of those operators who are entitled to cost-orientated interconnect charges from BT).
